Welcome to PharmaC. By visiting our store, mobile app, or using any of our services, you agree to the following Terms of Service. These terms govern your access and use of all content, features, products, tools, and services provided by PharmaC ("we", "our", or "us"). Our services are powered by Shopify, a third-party platform enabling secure and seamless eCommerce functionality.
SECTION 1 - GENERAL CONDITIONS
You agree to use our services only for lawful purposes and in accordance with all applicable laws and regulations. We reserve the right to refuse service to anyone, at any time, for any reason. By agreeing to these Terms, you confirm that you are at least the age of majority in your country or region or are accessing the service under the supervision of a parent or legal guardian.
SECTION 2 - ACCOUNT REGISTRATION
To access certain features or complete purchases, you may be required to register an account. You agree to provide accurate and current information and to update it as needed. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. We are not liable for any loss resulting from unauthorized access.
SECTION 3 - PRODUCTS & ORDERS
We aim to display product information as accurately as possible. However, colors, packaging, and minor product details may vary. All orders are subject to acceptance and availability. PharmaC reserves the right to limit, cancel, or refuse any order at our discretion. Orders are for personal use only and must comply with our Return & Refund Policy.
SECTION 4 - PRICING & PAYMENTS
All prices are displayed in Kuwaiti Dinar (KWD) and include applicable taxes unless otherwise noted. Prices and promotions are subject to change without prior notice. You agree to provide valid and up-to-date payment details. Payments are securely processed through authorized third-party platforms.
SECTION 5 - SHIPPING & DELIVERY
We offer 2-hour delivery within Kuwait via trusted third-party logistics providers. Delivery times are estimates and may vary due to circumstances beyond our control. Risk of loss and title for items pass to you upon delivery to the carrier.
SECTION 6 - RETURN & CANCELLATION POLICY
We offer a 14-day return policy. Returned items must be unused, unopened, and in original packaging. Certain items like personal care and hygiene products are non-returnable. Cancellations are accepted within 5 minutes of order placement. Refer to our full Return & Refund Policy for detailed terms.
SECTION 7 - INVENTORY & ORDER FULFILLMENT
All inventory and fulfillment operations are synced with our ERP system to ensure stock accuracy and proper order processing. PharmaC reserves the right to cancel or delay orders in the case of inventory discrepancies, expired products, or unexpected stockouts.
SECTION 8 - INTELLECTUAL PROPERTY
All trademarks, service marks, brand elements, and content displayed or made available through PharmaC are owned or licensed by us. You may not use, copy, reproduce, modify, or distribute any part of our content without prior written consent.
SECTION 9 - USER CONDUCT
You agree not to engage in unlawful, abusive, or disruptive behavior while using our services. This includes but is not limited to spamming, transmitting viruses, infringing on rights, or attempting unauthorized access to our systems. Violations may result in suspension or termination of access.
SECTION 10 - THIRD-PARTY LINKS & SERVICES
Our website and app may contain links to third-party websites or services. These are provided for convenience only. We do not control or endorse third-party content and disclaim all liability for any transactions or interactions with such sites.
SECTION 11 - SHOPIFY RELATIONSHIP
PharmaC is hosted on Shopify. While Shopify powers our eCommerce platform, all transactions, shipping, and customer service responsibilities rest solely with PharmaC. Shopify is not a party to any purchase agreement between you and PharmaC.
SECTION 12 - CUSTOMER FEEDBACK & SUBMISSIONS
By submitting reviews, questions, or other feedback, you grant us the right to use, reproduce, and distribute such content for marketing or improvement purposes. We are not obligated to compensate or acknowledge contributors.
SECTION 13 - DISCLAIMER OF WARRANTIES
Our services and content are provided "as is" and "as available" without any warranties of any kind, express or implied. We do not guarantee that the services will be uninterrupted or error-free, and you agree that your use is at your own risk.

PharmaC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or purchase of our products. Our total liability for any claim will not exceed the amount paid for the applicable product or service.

You agree to indemnify, defend, and hold PharmaC harmless from any claims, damages, or liabilities arising from your use of our services or breach of these Terms.

We may suspend or terminate your account or access to services at our sole discretion, without notice, for behavior that violates these Terms. All obligations related to outstanding payments, indemnification, and limitations of liability shall survive termination.

These Terms are governed by the laws of the State of Kuwait. Disputes arising from your use of the services shall be submitted to the exclusive jurisdiction of Kuwaiti courts.

We reserve the right to modify these Terms at any time. Updated versions will be posted on our website with a revised date. Continued use of our services after such updates constitutes acceptance.
